Liability Waiver

Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement (the AGREEMENT)

For the participation in Goshu Judokan activities (the ACTIVITY) by myself/my minor (the PARTICIPANT), I (the UNDERSIGNED) hereby acknowledge, agree and represent:

The UNDERSIGNED has full authority and capacity to act on behalf of the PARTICIPANT and to acknowledge, agree and represent this AGREEMENT.
The PARTICIPANT and UNDERSIGNED understand the nature of the ACTIVITY and that the PARTICIPANT is qualified, in good health and proper physical and mental condition to participate in such ACTIVITY. The PARTICIPANT and UNDERSIGNED further agrees and warrants that if at any time the PARTICIPANT or UNDERSIGNED believes conditions to be unsafe or the PARTICIPANT is unable to safely participate in the ACTIVITY, the PARTICIPANT or UNDERSIGNED will immediately discontinue further participation of the PARTICIPANT in the ACTIVITY and immediately notify the persons in charge, other participants and any other persons necessary to the best of the PARTICIPANT's or UNDERSIGNED's ability.
The PARTICIPANT and UNDERSIGNED fully understand and acknowledge that:
1. The ACTIVITY involves risks and dangers of serious bodily injury, including but not limited to permanent disability, paralysis and death (the RISKS); and expressly acknowledge that injuries received may be compounded or increased by negligent rescue operations or procedures of the RELEASEES named below.
2. The RISKS may be caused by the PARTICIPANT's actions or inactions, the actions or inactions of others participating in the ACTIVITY, the condition in which the ACTIVITY takes place, or the negligence of the RELEASEES named below.
3. There may be other risks and social and economic losses either not known, or not readily foreseeable at this time that can permanently affect the PARTICIPANT's or UNDERSIGNED's future; and the PARTICIPANT and UNDERSIGNED fully accept and assume all such risks and all responsibility for losses, costs, and damages the PATICIPANT or UNDERSIGNED incur as a result of participation in the ACTIVITY.
The PARTICIPANT and UNDERSIGNED releases, waives, discharges and covenants not to sue Goshu Judokan and its affiliates, the respective administrators, directors, agents, officers, members, volunteers, employees, other participants in the ACTIVITY, sponsors, advertisers, anyone who gives recommendations, directions, instructions or engages in the ACTIVITY, and if applicable, the owners and lessors of premises in which the ACTIVITY takes place (each considered one of the RELEASEES), from all liability to the PARTICIPANT, the UNDERSIGNED, personal representatives, assigns, heirs, and next of kin for any and all claims, demands, losses, damages to the PARTICIPANT or their property, damages to the UNDERSIGNED's property, or injuries to or death of the PARTICIPANT, caused or alleged to be caused in whole or in part by the negligence of the RELEASEES or otherwise, including negligent rescue operations or otherwise.
The PARTICIPANT and UNDERSIGNED agree that if, despite this AGREEMENT, the PARTICIPANT or UNDERSIGNED or anyone on their behalf makes a claim against any of the RELEASEES, the PARTICIPANT and UNDERSIGNED will indemnify, save, and hold harmless each of the RELEASEES from any loss, liability, damage or cost the PARTICIPANT and UNDERSIGNED may incur arising out of such claims, whether caused by the neglience of the RELEASEES or otherwise, including but not limited to litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claims.
The PARTICIPANT and UNDERSIGNED assume full responsibility for any of the risks identified in this AGREEMENT or during the ACTIVITY, towards the PARTICIPANT and UNDERSIGNED, whether caused by the negligence of the RELEASEES or otherwise.
The PARTICIPANT and UNDERSIGNED agree that this AGREEMENT extends to all acts of negligence by the RELEASEES, including negligent rescue operations, and is intended to be as broad and inclusive as is permitted by the laws of the State or Territory in which the ACTIVITY is conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

By ticking the following box, the PARTICIPANT and UNDERSIGNED truthfully signify that the PARTICIPANT and UNDERSIGNED have read this AGREEMENT, fully understand its terms and agree to it, understand that the PARTICIPANT and UNDERSIGNED have given up substantial rights by agreeing to it, and that the PARTICIPANT and UNDERSIGNED have agreed to it freely and without inducement or assurance or guarantee of any nature being made to the PARTICIPANT or UNDERSIGNED, and intend the UNDERSIGNED's agreement to be a complete and unconditional release of all liability to the greatest extent allowed by law.
